THE NEXT STEPS – THE OMB HEARING

A Pre-Hearing conference is scheduled at the Ontario Municipal Board offices located at 655 Bay Street, 16th Floor, Toronto at 10:00 a.m. on Friday, March 21, 2014.

The purpose of this conference is to determine who will be participating at the hearing. We anticipate the hearing will last approximately 8-10 days in late 2014 or early 2015.

There are two ways of participating in an OMB hearing: as a party or as a participant.

A party must attend the entire hearing and has the right to cross examine witnesses and provide witnesses in support of his/her position. A party is usually represented by a lawyer.

The High Park Coalition intends to register as a party to this proceeding.

A participant does not have to attend the entire hearing and will be permitted to give a brief presentation to the Board stating their reasons why they oppose the application.

A participant will only have to attend the hearing on the day of their scheduled presentation. Participants are not usually represented by counsel and have to provide a participant’s statement (normally one or two pages) outlining their position. The statement will be filed with the Board and distributed to all parties to the hearing. 

We believe it is important to get as many individuals as possible to sign up as participants to the OMB hearing to demonstrate the widespread community opposition to this application.

We encourage all of you to attend at the Pre-Hearing Conference to sign up as participants so that the Board is aware of how the local residents have become engaged in challenging this matter.

If you cannot attend the Pre-Hearing Conference, you can still send a letter to the Board indicating your desire to be a participant. A sample letter is provided here for your reference. Please note that your letter must be received before Friday March 21, 2014.

We hope that many of you decide to sign up as participants in this hearing. We feel it is important the OMB understands how strong the opposition of the local community is to this application.
